📄 Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Expiry mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

These Terms constitute a legal agreement between you and KYY Technologies Inc and TebCal Corp (collectively, "Expiry," "we," "our," or "us").

2. Description of service

Expiry is a mobile application that helps users track expiration dates of food, medications, and personal care products. The Service includes:

• Barcode scanning to identify products
• Manual entry of expiration dates
• Push and email notifications when products are approaching expiration
• Pantry inventory management
• Recipe suggestions for products nearing expiration (where available)
• General guidance on how to safely dispose of expired food, medicine, and personal care products
• General tips on composting and garden reuse of expired organic materials

3. Accounts and registration

To use Expiry, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate and complete information during registration
• Keep your password secure and not share it with others
• Notify us immediately if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for abusive purposes.

4. Free and paid plans

Expiry offers the following service tiers:

Paid subscriptions are billed monthly. You may cancel your subscription at any time, and access to paid features will continue until the end of your current billing period. We do not offer refunds for partial months.

We reserve the right to change pricing with at least 30 days' notice to subscribers.

5. Acceptable use

You agree to use Expiry only for its intended purpose. You must not:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use automated tools (bots, scrapers) to access the Service
• Overload our infrastructure through excessive requests or denial-of-service attacks
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit malicious code, viruses, or any software designed to disrupt the Service
• Use the Service to send spam or unsolicited communications

Violations of these restrictions may result in immediate account termination.

6. Your content

You retain ownership of all content you submit to Expiry, including product names, dates, and notes. By submitting content, you grant us a limited license to store and display that content solely for the purpose of providing the Service to you.

You are responsible for ensuring that the content you submit does not violate any third-party rights or applicable laws.

We do not use your pantry data to train AI models, sell to third parties, or use for any purpose other than operating the Service as described in our Privacy Policy.

Used item retention. When you mark a product as "used," it is moved to your History tab and retained for 60 days from that date, after which it is automatically and permanently deleted from our servers. You may delete used items manually from your History at any time before that period expires.

7. Intellectual property

The Expiry application, including its design, logo, code, and content created by us, is owned by KYY Technologies Inc and TebCal Corp and is protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written permission.

7b. Third-party data sources and attribution

Expiry uses the following third-party data sources and services. Their respective terms and licenses apply to the data they provide:

Open Food Facts, Open Beauty Facts, Open Products Facts

Product data retrieved via barcode lookup is sourced from Open Food Facts, Open Beauty Facts, and Open Products Facts. These databases are made available under the Open Database License (ODbL) v1.0, and their contents under Creative Commons Attribution-ShareAlike 3.0. In accordance with these licenses, we acknowledge Open Food Facts, Open Beauty Facts, and Open Products Facts as the source of the product data used in this application.

Spoonacular

Recipe suggestions in Expiry are powered by the Spoonacular Food API. Recipe data, images, and related content are provided by Spoonacular and are subject to Spoonacular's Terms of Service. We do not claim ownership of any recipe content returned by their API. Recipe suggestions are provided for informational purposes only.

Expo

Push notification delivery is powered by Expo. By enabling push notifications, you acknowledge that notification tokens are processed through Expo's infrastructure subject to Expo's Privacy Policy.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• Product information obtained via barcode scanning is accurate, current, or complete
• Notifications will be delivered at any specific time or at all
• The Service will meet your specific requirements
• Any content in the app is free from errors, omissions, or inaccuracies

8a. Expiration date reminders. Expiry notifications are reminders based on dates you manually enter or that are retrieved from third-party databases. We make no representation that these dates are accurate, that a product is safe to consume before its listed date, or that a product is unsafe after it. Always use your own sensory judgment. KYY Technologies Inc and TebCal Corp are not liable for any illness, injury, or loss arising from consuming or not consuming a product based on information shown in the app.

8b. Recipe suggestions. Recipes surfaced by Expiry are sourced from the Spoonacular API and are provided for general informational and inspirational purposes only. They do not constitute professional nutritional, culinary, dietary, or medical advice. We make no representation that any recipe is:

• Safe or suitable for your specific health condition, dietary restriction, or allergy
• Free from ingredients that may cause allergic reactions, food intolerance symptoms, or other adverse health effects
• Prepared, cooked, or stored in a manner that eliminates food safety risk
• Appropriate for children, pregnant individuals, elderly persons, or immunocompromised individuals

You are solely responsible for verifying the suitability of any recipe before preparing or consuming it. If you have food allergies, intolerances, or medical dietary requirements, consult a qualified healthcare professional before acting on any recipe suggestion. KYY Technologies Inc and TebCal Corp are not liable for any illness, allergic reaction, injury, or adverse health outcome arising from following, attempting, or consuming any recipe suggested by the app.

8c. Disposal and safe-handling guidance. Tips on how to dispose of expired food, medications, and personal care products are provided as general guidance only. They do not constitute professional advice from environmental, public health, waste management, or regulatory authorities. Applicable regulations vary by city, county, and state. We make no representation that our suggestions comply with your local waste disposal laws or are appropriate for your specific situation. You are solely responsible for verifying local regulations and disposing of products in compliance with applicable law. KYY Technologies Inc and TebCal Corp are not liable for any fines, property damage, environmental harm, personal injury, or other consequences arising from following our disposal guidance.

8d. Garden and composting tips. Suggestions for reusing expired organic materials in gardens, compost, or outdoor spaces are provided for general informational purposes only. They do not constitute professional horticultural, agricultural, or environmental advice. Results vary based on soil type, climate, plant species, local conditions, and numerous other factors outside our control. We make no representation that any garden tip will produce the described outcome, be safe for your plants, or be appropriate for your specific property. KYY Technologies Inc and TebCal Corp are not liable for any property damage, plant damage or death, soil contamination, pest infestation, or any other outcome arising from following our garden or composting suggestions.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KYY TECHNOLOGIES INC AND TEBCAL CORP, THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, loss of profits, or business interruption
• Personal injury, illness, food poisoning, allergic reactions, or adverse health effects arising from consuming any food or beverage based on expiration information or recipe suggestions provided by the app
• Harm resulting from following disposal guidance, including but not limited to fines, regulatory penalties, property damage, or environmental harm
• Damage to plants, soil, gardens, or property resulting from following composting or garden reuse tips provided by the app
• Any harm resulting from dietary preferences or intolerance filters that fail to exclude an ingredient you are sensitive to
• Any loss or damage arising from your reliance on third-party content including recipes from Spoonacular or product data from Open Food Facts

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY — WHETHER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — EVEN IF KYY TECHNOLOGIES INC OR TEBCAL CORP HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any and all claims arising from your use of the Service shall not exceed the total amount you paid us in the 12 months immediately preceding the claim. If you have not paid us anything during that period, our total liability to you is zero dollars (USD $0.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Termination

You may stop using the Service and delete your account at any time by contacting us at [email protected].

We may suspend or terminate your account at any time if you violate these Terms. We will make reasonable efforts to notify you before doing so, except in cases of serious violations.

Upon termination, your right to use the Service ceases immediately. We will delete your data as described in our Privacy Policy.

11. Governing law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you through the app or via email at least 14 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.
